EVERTON PARISH COUNCIL

Minutes of a meeting of the Council 
held in the Village Hall on Monday 1st November, 2004

04/05/175 APOLOGIES

An apology for absence was submitted from Councillor de Bel (work).

04/05/176 DECLARATIONS OF INTEREST

There were no declarations of interest. 

04/05/177 MINUTES OF THE LAST ORDINARY MEETING OF THE COUNCIL, HELD ON 4TH OCTOBER, 2004

The Minutes of the last meeting of the Council, held on 4th October, 2004, were approved as a correct record.

04/05/178 MATTERS ARISING 

The Clerk referred to Minute No. 04/05/157 (Parish Plan) and reported receipt of the following letters which had arrived since the agenda was printed:

(a) from Mr. John Mann, MP, stating that he had written to Nottinghamshire Police and Royal Mail over the Parish Council's concerns regarding the desirability of a more-appropriate post code regime for the area.

(b) from Nottinghamshire Police, stating that the Parish Council's concerns over the Police telecommunications system were being examined.

(c) from A1 Housing Bassetlaw Ltd., stating that the Parish Council's request for additional lighting at Carr View was to be examined.



04/05/179 PUBLIC DISCUSSION

No members of the public were present 

04/05/180 ACCOUNTS

Resolved:- That the November Accounts be approved for payment.

04/05/181 BANK RECONCILIATION

Members received the bank reconciliation statement to 30th September, 2004. 

04/05/182 BUDGET MONITORING

There were no changes which needed reporting.

04/05/183 RISK

There were no changes to the Parish Council's risk profile since the last meeting. Members noted that the Clerk was to attend a full-day course on risk assessment, to be held at Farnsfield on Saturday 20th November, 2004.

04/05/184 PARISH PLAN

Councillor Bardsley reported that he was hoping to arrange the first meeting of the Parish Plan Working Party on 15th November, 2004. 

04/05/185 NORTH EAST BASSETLAW FORUM 

The Chairman reported that the Village Hall would be the venue for a meeting of the Forum to be held on 7th June, 2005.

04/05/186 QUALITY PARISH COUNCIL ACCREDITATION

The October newsletter had been published, and the next step was preparation of the January, 2005 newsletter.

The Parish Council was on-course for accreditation in 2006. 

04/05/187 PARISH PATHS PARTNERSHIP

Pursuant to Minute No. 04/05/156(a) of October, 2004, the Clerk updated Members on the current position regarding the establishment of a public footpath on Old Mattersey Road from Eel Pool Road to the footbridge on the River Idle.

Following consultation with Nottinghamshire County Council, the Clerk had written to the owners of the land concerned, explaining the situation, and suggesting that, in order to rectify the matter, the best way forward would be for the owners to contact the County Council with a view to agreeing to dedicate a footpath. This was the most straightforward way of tackling the problem. Otherwise the Parish Council would have to apply for a creation order.

A reply had been received from the owners, in which they explained what they had done to improve the amenity of the land concerned, but in which they took offence at what they saw as a negative approach by the Parish Council including a failure to consult. The Clerk had written again to the owners, explaining that it was not the Parish Council's intention to cause offence in any way, and requesting an indication as to whether the owners were prepared to dedicate a footpath. No further correspondence had been received.

Members expressed the view that it was most unfortunate that a mistake by the County Council some years ago had led to a situation whereby the Parish Council was having to take action to rectify the matter, with consequential friction being caused with parishioners. It was agreed, however, that the matter would have to be rectified, although the Clerk was requested to wait a little longer before proceeding with an application for a creation order, in the hope that a positive reply from the landowners regarding a dedication might be forthcoming. 

04/05/188 A631 IMPROVEMENTS

There was no further progress to report.

04/05/189 OFFICE OF THE DEPUTY PRIME MINISTER - CONSULTATIONS ON (1) A DRAFT CODE OF CONDUCT FOR LOCAL GOVERNMENT EMPLOYEES AND (2) A REVIEW OF RESTRICTIONS ON THE POLITICAL ACTIVITIES OF LOCAL AUTHORITY EMPLOYEES AND PAY OF POLITICAL ASSISTANTS

This document had been circulated, but Members did not wish to make any observations.

04/05/190 LICENSING ACT POLICY STATEMENT

This Bassetlaw District Council consultation document was in circulation, and would be considered at the December meeting. 

04/05/191 TUNNEL TECH NORTH LTD. 

Councillor Bardsley kindly agreed to make enquiries regarding a possible meeting on the Tunnel Tech problem.

Members were furnished with copies of (a) a Bassetlaw District Council document entitled ‘Summary of Action and Possible Outcomes’ and (b) new government guidance on the conditions appropriate for the control of emissions into the air from mushroom substrate manufacturing processes/installations. 

04/05/192 METCALFE CHARITABLE TRUST

Resolved:- That Councillor Dunn be nominated to replace Councillor de Bel as a Parish Council representative on the Metcalfe Charitable Trust, at the end of Councillor de Bel’s period of office.

04/05/193 COMMUNITY SHOPS

Pursuant to Minute No. 04/05/149 of October, 2004, a brief discussion took place, when Members were in agreement that it would be helpful for a community shop elsewhere to be visited on a fact finding mission. Mrs. Sue Hughes, of the Parish Plan Facilities Action Group, was in attendance, and made specific reference to the costly and voluntary commitment that would be required in order to achieve sustainability over the medium to long term.

Resolved:- That the Clerk endeavour to make arrangements for a visit to a community shop by the Chairman and Mrs. Hughes.

04/05/194 METCALFE RECREATION COMMITTEE

The Chairman reported that arrangements were being made for suitable amendments to the hire booking agreement which the Metcalfe Recreation Committee required the Parish Council to sign.

An E-mail from Mr. Richard Scott, Secretary of the Metcalfe Recreation Committee on this matter also thanked the Parish Council for the second half of its annual donation, and informed the Parish Council that the Metcalfe Charitable Trust had given notice that it wished the Recreation Committee to be self-funding within two years. This meant that the only external funding available to the Recreation Committee would be the Parish Council's annual donation.

A discussion ensued on the question of external funding, when Councillor Maclagan explained that the decision of the Trust was a commercial necessity. He also provided other information about the administrative and financial relationship between the Trust and the Recreation Committee.



04/05/195 PARISH COUNCILS LIAISON GROUP

Letter was submitted from Bassetlaw District Council, inviting the Parish Council to be represented at a meeting of the above, to be held at Worksop on 29th November, 2004. The letter also invited the Parish Council to submit agenda items.

Resolved:- 

(a) That the Parish Council be represented at the meeting by the Chairman and Councillor Bardsley.

(b) That the following agenda items be submitted:

Ÿ Policy changes following the change of administration at Bassetlaw District Council, including an update on policy on concurrent, and other, grants to parish councils

Ÿ Compliance with Bassetlaw District Council’s policy on answering letters 

04/05/196 INTERNET PROMOTION OPPORTUNITY

Discussion took place regarding the possibility of submitting general information about the Parish for inclusion on www.information-britain.co.uk.

Resolved:- That, subject to the Clerk being satisfied that there were no financial implications, the text prepared by Councillor Bardsley be submitted for inclusion on this web site, subject to minor amendment.

04/05/197 CRIME STATISTICS

The October crime statistics were submitted.

The Clerk agreed to request P.c. Gregson’s observations on the recent level of crime.

04/05/198 DOG WASTE

The Clerk agreed to contact the Bassetlaw Dog Warden regarding the possibility of having a dog waste bin on Pinfold Lane.



04/05/199 WWW.BUYENGLAND.COM - PLOTS OF LAND FOR SALE AT BROOMFIELD LANE, EVERTON

A discussion took place about a USA web site offering plots of land in England for sale. A site at Broomfield Lane, Everton was included, in which 142 dwelling plots were shown on a drawing and offered for sale, with less than 20 remaining.

Members noted that there was no planning permission in place for this development and that no planning application had been notified to the Parish Council. 

04/05/200 DEMOLITION OF GRADE II LISTED PIGEONCOTE AND UNAUTHORISED DEVELOPMENT AT MANOR FARM, HARWELL

Pursuant to Minute No. 04/05/171 of October, 2004, the Clerk reported receipt of the following:

(a) Letter from English Heritage, confirming that Bassetlaw District Council had not yet formally responded to its letter of 25th August, 2004 about demolition of the listed pigeon cote, but that it understood that the agent acting for Manor Farm was in discussion with Bassetlaw District Council concerning this issue.

(b) E-mailed copy of a letter posted on 1st November, 2004 by Bassetlaw District Council Planning Department, stating that its Planning Consultation Group was shortly to decide whether to take enforcement action in respect of the wall built without planning permission at Manor Farm.

No correspondence had been received from Bassetlaw District Council regarding demolition of the listed pigeon cote, and the Clerk had earlier in the day E-mailed Bassetlaw District Council pressing the matter. Members expressed serious concern over the fact that Bassetlaw District Council had failed so far to formally respond to English Heritage.

The Clerk informed Members that District Councillor Martin had sought responses from Bassetlaw District Council to the two issues mentioned above, as requested by the Parish Council.

There were no planning applications.
