Minutes of a meeting of the Council held in the

05/06/108 RESIGNATION

Letter was submitted from Mr. Bob Troop, submitting his resignation from the Parish Council and associated committees, owing to his ongoing unavailability because of medical problems.

Resolved:

(a) That the Clerk write to Mr. Troop, expressing the appreciation of the Parish Council in respect of his long and excellent service to the Parish Council, Joint Burial Committee and community in general, together with best wishes for the future. 

(b) That the Clerk request Bassetlaw District Council to issue the Notice of Casual Vacancy for display on the notice boards.

05/06/109 APOLOGIES

An apology for absence was submitted by Councillor Jefferies (at Standards Board conference).

05/06/110 DECLARATIONS OF INTEREST

Councillors Bardsley and de Bel each declared a personal interest at agenda item 15 (North East Bassetlaw Forum Reports), being members of the North East Bassetlaw Forum.

Councillor Bardsley also declared a personal interest at agenda item 33 (Correspondence – Whaley Barn, Church Lane, Everton), being a friend of Mrs. Bailey, of Whaley Barn.

Councillor Marsh declared a personal interest at agenda item 33 (Correspondence – Flooding/Surface Water Problem at Pinfold Cottage, Pinfold Lane, Harwell), being a friend of Mr. & Mrs. Heeley, of Pinfold Cottage.



05/06/111 MINUTES OF THE LAST ORDINARY MEETING OF THE COUNCIL

The Minutes of the last ordinary meeting of the Council, held on 11th July, 2005, were approved as a correct record.

05/06/112 MINUTES OF AN EXTRAORDINARY MEETING OF THE COUNCIL

The Minutes of an extraordinary meeting of the Council, held on 26th July, 2005, were approved as a correct record.

05/06/113 MATTERS ARISING 

There were no matters arising.

05/06/114 PUBLIC DISCUSSION

District Councillor Martin expressed concern over the numbers of aircraft passing over Everton.

The Clerk reported that Gringley on the Hill Parish Council was to discuss recent near misses involving aircraft locally at its next meeting, with a view to the matter being considered by the North East Bassetlaw Forum.

Members agreed to discuss these issues at agenda item 15 – NEBF Reports. 

05/06/115 COMMUNITY PHYSICAL ACTIVITY

Ms. Sally Pygott was present to give a brief outline of her work as Community Physical Activity Officer for Nottinghamshire County Council, based at Bassetlaw District Council - East.

She had studied the Parish Plan, and was to visit Everton Primary School the following week. Councillor Bardsley agreed to put her in touch with Mrs. Sue Hughes re Parish Plan issues relating to community physical activity.

Ms. Pygott was thanked for her attendance. 

05/06/116 ACCOUNTS

Resolved: That the September Accounts be approved for payment.



05/06/117 BANK RECONCILIATION

Members received the bank reconciliation statement to 31st July, 2005.

05/06/118 BUDGET MONITORING

The Clerk submitted the September budget monitoring statement, which showed an estimated year-end balance of £4,189.

05/06/119 RISK REVIEW AND ASSET INSPECTION

There were no matters to report other than the theft of a gate, discussed later in the meeting.

05/06/120 MEMBERS’ SURGERIES

Members noted that the May, 2006 surgery had been changed from 20th to 13th.

05/06/121 PARISH PLAN

Councillor Bardsley submitted a Parish Plan update for the period to August, 2005 (appended to these Minutes). It referred to the Implementation Strategy, and contained a report on progress, outstanding issues and tabulated updated work programme.

A further meeting of the Parish Plan Working Group was to take place before Christmas.

Councillor Bardsley agreed to establish the current position regarding an offer of football coaching by a local resident.

Resolved: That Councillor Bardsley be thanked for an excellent report.

05/06/122 NORTH EAST BASSETLAW FORUM

(a) The Clerk reported that the next meeting of the Forum would be held at West Stockwith on 27th September, 2005. 

(b) Resolved: That, pursuant to discussion earlier in the meeting, the Forum be requested to consider the issues raised about aircraft in the area.

05/06/123 NALC NORTHERN AREA COMMITTEE

The minutes of the meeting held on 23rd May, 2005 were submitted. 




05/06/124 QUALITY COUNCILS

(a) The Clerk reported that, although he understood the requirement for public discussion at meetings to apply only to ordinary meetings, the position was not absolutely clear. He recommended, therefore, that public discussion appear as an agenda item at extraordinary meetings as well. 

Resolved: That the Clerk’s advice be accepted.

(b) Resolved: That, in order to assist the Clerk at what would be a particularly busy Spring in 2006, the Annual Parish Meeting be brought forward from 24th April to 3rd April, to commence at 7.00 p.m., followed by the scheduled meeting of the Parish Council.

05/06/125 PARISH PATHS PARTNERSHIP

(a) The Clerk reported that the gate fitted on Polly Bell Bank in 2004, to replace the stolen gate, had itself been stolen.

Resolved: That, prior to a decision being taken regarding a further replacement, the results of the Police investigation be awaited and discussions take place with the Crime Prevention Officer.

(b) Letter was submitted from Howard and Elaine Huntridge, The Merchant’s House, Nutcroft Way, Harwell, expressing concerns about the proposed formalisation of the footpath from Nutcroft Way to Barrow Hills through “The Shroggs”.

Resolved: That Howard and Elaine Huntridge be informed that this matter would remain in abeyance pending feedback from Thornely Taylor Estates Company regarding the proposed public footpath.

05/06/126 HIGHWAY MATTERS

(a) The Clerk reported that, following an expression of concern by the Chairman, he had contacted Nottinghamshire County Council about the overgrown oak tree on the grassed central area at the west end of Church Street.



The County Council had replied that the triangular area of land was in fact a village green, reinstated by the Parish Council in 1977 to celebrate the Silver Jubilee of the Queen. The Revd Metcalfe planted the oak tree to commemorate the coronation of King Edward VII in 1902. Two plaques on the green and tree confirmed this fact. However, the land was not registered with the County Council as a village green. 

In the circumstances, the Clerk had requested that the County Council’s tree service inspect the tree and hopefully take appropriate action, taking into consideration that the tree was effectively in the highway. 

(b) Members observed that the County Council had now provided a most-acceptable timber bus shelter on the A631 near Harwell, to replace the shelter demolished by vehicular impact in March, 2005. 

(c) Pursuant to Minute No. 05/06/87(c) of July, 2005, the Clerk reported that Nottinghamshire County Council had written to the occupier of Lime Tree Cottage, Bawtry Road, Everton, pointing out that vehicles parked on the grass verge of Bawtry Road in front of Lime Tree Cottage blocked visibility for drivers leaving the private access to properties at the rear and for vehicles exiting Mattersey Road. However, parking at this location remained a problem.

Resolved: That the Clerk write again to Nottinghamshire County Council about the problem.

(d) Pursuant to Minute No. 05/06/87(d) of July, 2005, a letter was submitted from Nottinghamshire County Council, stating that nothing could be done to address the problem of the narrow footpath near the southerly end of High Street because the existing widths of pavement and highway were insufficient to allow change.

It was agreed that consideration of this item be deferred to agenda item 21. – Building Better Communities. 

(e) Pursuant to Minute No. 05/06/28(b) of May, 2005, a letter was submitted from Nottinghamshire County Council, stating that the position regarding any agreement restricting use of Mattersey Road by aggregate lorries could not be confirmed. However, the Data Collection Team was to carry out two traffic surveys: the first would be at Lound crossroads and the second at the junction of Mattersey Road, Everton and the A631. Unfortunately, the Police had objected to the principle of further Environmental Traffic Regulation Orders.

Councillor Maclgagan kindly offered to conduct some research regarding the possible existence of an agreement relating to aggregate lorries.

(f) Pursuant to Minute No. 05/06/87(b) of July, 2005, a letter was submitted from Nottinghamshire County Council regarding the proposed interactive signs on the A631, and the Clerk confirmed that they were to be installed during the current financial year.

05/06/127 LIME TREE AVENUE – STREET NAMING

Pursuant to Minute No. 05/06/87(c) of July, 2005, the Clerk reported on discussions with Bassetlaw District Council relating to the difficulties involved in providing a street nameplate for Lime Tree Avenue, Everton.

During the ensuing discussion, Members observed that the properties on Lime Tree Avenue were clearly listed on the Register of Electors under Bawtry Road.

Resolved: That no further action be taken. 

05/06/128 TUNNELTECH NORTH

Councillors Bardsley and Marsh reported that they had been consulted on the new Defra process guidance note on the conditions appropriate for the control of emissions into the air from mushroom substrate manufacturing processes/installations. A very brief consultation period had been initially allowed, but that had now been considerably extended.

Councillor Bardsley’s and Marsh’s opinion was that the guidance note was heavily weighted towards commercial interests, with very little provision for effective enforcement. Councillor Bardsley expressed the opinion that the drafting of the document “would have done justice to Sir Humphrey Appleby”.

It was understood that Mr. Chris Booth, at Bassetlaw District Council Environmental Health, shared the concerns now expressed.

Resolved: That Councillors Bardsley and Marsh be authorised to respond to the consultation document in liaison with interested parties.

05/06/129 BUILDING BETTER COMMUNITIES

Pursuant to Minute No. 05/06/94, consideration was given to possible schemes for submission, through County Councillor Bullivant, to Nottinghamshire County Council. 

Resolved: 

(a) That the following schemes be submitted:

· Lighting at Harwell Road/A631 junction

· Pavement and highway improvements near the southern end of High Street – as per discussion earlier in the meeting – possibly by footpath widening and introduction of a traffic priority scheme

(b) That consideration of parking for visitors to Barrow Hills Woods be deferred for the time being.

(c) That the Clerk press Bassetlaw District Council for a decision on the provision of street nameplates on Gainsborough Road (old) towards Drakeholes. 

05/06/130 ENDING OF WORLD WAR II - CIVIC COMMEMORATION 

Pursuant to Minute No. 05/06/95 of July, 2005, consideration was given to a possible civic commemoration in the Cemetery and laying of a wreath at the War Memorial to mark the 60th anniversary of the ending of World War II.

Resolved: That a civic commemoration take place on Sunday 13th November, 2005, with arrangements to be made by the Chairman and Councillor de Bel.

05/06/131 WEBSITE MANAGEMENT

The Clerk reported that, because of technical difficulties he had encountered, he had sought help from BCVS, which was now effectively managing the village website. He requested Members to consider paying a monthly management fee to BCVS.

Whilst discussing the matter, Councillor Maclagan observed that there was a shortage of input from local organisations on the website. He would discuss the matter with Mr. Tony Connold with a view to possibly including information from the new Welcome booklet. 

Resolved: 

(a) That, with effect from 1st September, 2005, a monthly management fee of £20 be paid to BCVS. 

(b) That a standing note be included in HEDS Together, giving the address of the website.


05/06/132 CPRE BEST KEPT VILLAGE COMPETITION

Correspondence was submitted from CPRE, giving details of the 2005 awards. Whilst neither Everton nor Harwell had made it through to the finals of the competition, the Metcalfe Recreation Ground had been awarded one of three countywide certificates of merit. The certificate would be presented at the Annual General Meeting of the Nottinghamshire Local Councils Association at Southwell on 16th November, 2005. 

The CPRE had been very impressed with Everton, but considered that next year it should enter the 300 to 700 category, which meant that the small part of Drakeholes within the Parish would not be included.

A letter was also submitted from Councillor Michael Bennett, Chairman of Bassetlaw District Council, congratulating everyone involved on the award of the certificate.

Resolved:

(a) That two entries be made in the 2006 competition: the village of Everton in the 300 to 700 population category and the hamlet of Harwell in the up to 300 population category.

(b) That Mr. John Leach, Chairman of the Metcalfe Charitable Trust, be invited to attend the award ceremony, to be accompanied by Councillors Maclagan and Jefferies.

(c) That the Clerk write to the Secretaries of the Metcalfe Charitable Trust and the Metcalfe Recreation Committee, expressing the congratulations of the Parish Council on their achievement and inviting anyone wishing to attend the award ceremony to do so. 

05/06/133 NOTTINGHAMSHIRE ASSOCIATION OF LOCAL COUNCILS 

Correspondence was submitted as follows:

(a) An invitation to attend the Annual General Meeting at Southwell on 16th November, 2005 was noted, attendance having been arranged at the previous item.

(b) A letter regarding long service nominations. The Clerk agreed to discuss the matter with Councillor Jefferies.

(c) An overview of responses to the 2005 questionnaire was noted.

(d) An invitation to the Clerk to attend a training course on VAT at Ranby on 29th September, 2005 was accepted.

(e) An invitation to Members to attend a playground inspection workshop at Edwinstowe on 24th September, 2005 would be forwarded to the Secretaries of the Metcalfe Charitable Trust and Recreation Committee.

05/06/134 VOLUNTARY FIRST REGISTRATION OF TITLE

Letter was submitted from the Land Registry, encouraging landowners to voluntarily register title to land.

The Clerk reported that he met a representative of the Land Registry to discuss this matter on 25th August, 2005, when it became apparent that the only piece of land that needed to be registered was the Cemetery (other Parish lands already in the process of registration).

Resolved: That the Joint Burial Committee be recommended to attend to this matter once the registration of parish lands was complete.

05/06/135 DONATIONS

(a) A letter of thanks was submitted from HEDS Together.

(b) A letter was submitted from Mrs. Ann Hickman, requesting a donation for the 2005 Parochial Christmas Party.

Resolved: That a donation of £80 be made.

05/06/136 INSURANCE FOR VOLUNTEERS, ETC.

Letter was submitted from Allianz Cornhill Commercial, giving details of public and employer’s liability cover for volunteers. The letter also dealt with insurance requirements relating to delegated functions.

Resolved: That the Clerk seek clarification from the company on a point relating to use of tools, materials and equipment.

05/06/137 BASSETLAW CIVIC SERVICE – SUNDAY 9TH OCTOBER, 2005 – ST. ANNE’S CHURCH, WORKSOP

Members noted a letter from Bassetlaw District Council, inviting the Parish Council to be represented at the above.

05/06/138 MAINS GAS

The Clerk reported that, following a further approach by District Councillor Martin to Bassetlaw District Council, he had been informed that the District Council was to conduct research into grant availability, lobbying, etc.


05/06/139 THE SUSTAINABLE COMMUNITIES BILL

Letter was submitted from Local Works, inviting the Parish Council to support the campaign to end ghost town Britain and promote sustainable communities – The Sustainable Communities Bill. The Parish Council was requested to:

· pass a suggested resolution
· ask John Mann, MP to support the Bill by signing parliamentary resolution Early Day Motion 641
· inform Local Works of the Parish Council's support

Resolved: That approval be given to the above.

05/06/140 CRIME STATISTICS

The crime statistics for July and August were noted.

The Clerk was asked to enquire why the theft of a gate from Polly Bell Bank was not included in the statistics.

05/06/141 BASSETLAW PRIMARY CARE TRUST’S ANNUAL PUBLIC MEETING

Members noted an invitation to attend the above, to be held at Worksop on 27th September, 2005.

05/06/142 THE BASSETLAW PLANNING PROCESS

District Councillor Martin left the meeting at this point.

Pursuant to Minute No. 05/06/97 of July, 2005, letters were submitted as follows:

(a) From the Head of Law and Scrutiny Services/Monitoring Officer at Bassetlaw District Council, answering some of the questions asked by the Parish Council at the July meeting. The main point of the letter was that the question of whether an elected Member had a personal or a personal and prejudicial interest was entirely a matter of judgement for the individual Member, and could not be commented on.

(b) From the Head of Planning Services at Bassetlaw District Council, giving a limited answer to the questions asked by the Parish Council at the June meeting.

With regard to the letter from the Head of Law and Scrutiny Services/Monitoring Officer, Members expressed concern over the fact that the explanation failed to assuage concerns about the absence of Parish representation on planning issues in many instances.

With regard to the letter from the Head of Planning Services, Members expressed further concern over the fact that it made no attempt to answer many of the technical questions asked. 

Resolved: 

(i) That the Clerk write to the Chief Executive of Bassetlaw District Council, informing him that the Parish Council had lost confidence in the Bassetlaw Planning process.

(ii) That North East Bassetlaw Forum be requested to included a discussion item on a future agenda relating to concerns over the Bassetlaw Planning process.

05/06/143 DEMOLISH EXISTING OUTBUILDINGS AND ERECT ONE DWELLING AT CARR HILL FARM, HARWELL LANE, HARWELL 19/05/6

Notice of Appeal was submitted.

05/06/144 SITING OF CARAVANS ON LAND OFF STONEHILL LANE, EVERTON, ADJACENT TO THE A631

Letter was submitted from Bassetlaw District Council, confirming that a breach of planning control had been established with regard to the siting of residential caravans on land off Stonehill Lane, Everton. The matter was being pursued.

05/06/145 ERECTION OF FOUR DWELLINGS OFF SLUICE LANE, HARWELL 19/05/2

Letter was submitted from Bassetlaw District Council, confirming that no breach of planning control had been established with regard to site access from Pinfold Lane.

05/06/146 ERECT REPLACEMENT PIGEON COTE TO CREATE A GARAGE AND ANCILLARY DOMESTIC ACCOMMODATION, ALTER EXISTING ACCESS AT MANOR FARM, SLUICE LANE, HARWELL 19/04/42

The Clerk agreed to ascertain the current status of this application which was considered by the Parish Council on 7th February, 2005.

The Clerk reported that he had relodged the Parish Council's previous strong objection to this application after consultation with Members.

Erect 15m high telecommunications tower, three antennas, two 300mm diameter dish antenna, radio equipment housing and ancillary development on land at Everton Nurseries, Gainsborough Road, Everton

Resolved: That Bassetlaw District Council be informed that, although the Parish Council was pre-consulted about this application, the documentation was very brief, not containing the detail now submitted. The Parish Council did not at that stage find itself able to comment on the limited information available.

Now that full details were available, the Parish Council considered that, as this was the type of application that would generate considerable public interest and possible concern, the applicant (and hopefully the Planning Department) should be requested to give a public presentation to the people of Everton about the application, before the Parish Council made its observations and before the application was determined by the District Council.
