EVERTON PARISH COUNCIL


Minutes of a meeting of the Council held in the 
Village Hall on Monday 6th June, 2005

Present:- Councillor J. Dunn, Chairman. Councillors Bacon, Bardsley, de Bel, Jefferies, Maclagan, Marsh and Woods


05/06/41 APOLOGIES

Apologies for absence were submitted by Councillor Troop (unwell) and District Councillor Martin.

Resolved: That, for the purposes of Section 85(1) of the Local Government Act 1972, it be accepted that Councillor Troop’s unfortunate illness made his absence from Parish Council meetings unavoidable. 

05/06/42 DECLARATIONS OF INTEREST

Councillors Bardsley, de Bel and Jefferies each declared a personal interest at agenda item 12 (North East Bassetlaw Forum Reports), being members of the North East Bassetlaw Forum.

Councillor Jefferies declared a personal interest at agenda item 13 (NALC Northern Area Committee Reports), being the Parish Council representative on the Northern Area Committee.

05/06/43 MINUTES OF THE ANNUAL MEETING OF THE COUNCIL

The Minutes of the Annual Meeting of the Council, held on 9th May, 2005, were approved as a correct record.

05/06/44 MATTERS ARISING 

The Clerk informed Members that, pursuant to Minute No. 05/06/14 of May, 2005, the Internal Auditor’s report had arrived indicating that everything was satisfactory. A copy would be submitted to the next meeting.


05/06/45 PUBLIC DISCUSSION

A number of Harwell residents attended to express their dismay and disappointment at recent actions by Bassetlaw District Council, including the granting of planning permission for four houses at Sluice Lane, Harwell (19/04/29), and the granting of planning permission, by officers instead of the Planning Committee, for a replacement dwelling at Micklebring Lodge, Nutcroft Way, Harwell (19/05/5), when several strong objections had been lodged.

They expressed concern that, with regard to the Sluice Lane application, the reason given for approval was the same reason given by the Inspector at the earlier appeal justifying refusal; that there was no recorded vote at the Planning Committee even though all the preceding applications that evening were so recorded; that Councillor Oxby denied that Harwell was a rural area, and that Harwell was referred to in the report to the Planning Committee and by several Members of the Planning Committee as a village, whereas it was in fact a hamlet.

They informed Members that they were aware, that, if planning permission had been refused, the applicant company would have reverted to its original plan to build two houses instead of four. 

They also asked for guidance on the best way to challenge the decision, and were advised by the Clerk that the formal complaint procedure was the most appropriate. In that regard, Mr. Paul Bacon furnished the Clerk with a copy of a letter he had sent to Bassetlaw District Council.

They also expressed concern that the decision at 19/05/5 would, one way or another, mean that the unauthorised Barrow Cragg development across the road at Nutcroft Way would be allowed to stay after all, despite the wishes of the Planning Committee.

Members confirmed that they shared residents’ concerns over these matters, and stressed the fact that the Parish Council had done everything in its power to oppose the two applications. There was to be a discussion on the Bassetlaw Planning process later in the evening.

Before they left the meeting, the residents expressed their appreciation to the Parish Council in respect of everything it had done to try to protect the character of Harwell as a hamlet. 

05/06/46 ACCOUNTS

Resolved:- That the June Accounts be approved for payment.

05/06/47 BANK RECONCILIATION

Members received the bank reconciliation statement to 30th April, 2005. 

05/06/48 BUDGET MONITORING

There were no changes which needed reporting.

05/06/49 RISK REVIEW AND ASSET INSPECTION

(a) Councillor Marsh reported that the gate at the entrance to the SSSI at Pinfold Lane was now in urgent need of attention.

The Clerk informed Members that Councillor Troop had said that his son, Richard, would attend to the gate. The Clerk would follow the matter up.

(b) The Clerk reported that, pursuant to Minute No. 05/0613 of May, 2006, and in consultation with the Chairman, he had arranged for the repainting of the Cemetery gates and the seats in the Metcalfe Playing Field and at the Sun Inn crossroads, together with repairs and restaining of the bus shelter on Mattersey Road. 

(c) The Clerk submitted a draft street cleaning risk assessment for consideration.

Resolved: That the risk assessment be approved, as now amended, and copies be furnished to the Primary School, Brownies and Holy Trinity Church.

05/06/50 MEMBERS’ SURGERIES

Councillors Jefferies and Woods had attended the surgery on 21st May, 2005 when Mrs. K. Martin had attended to discuss airport noise from the new Robin Hood Airport. P.c. Gregson was also in attendance.

05/06/51 PARISH PLAN

(a) Councillor Bardsley reported that the implementation groups had met to review progress. He briefly reported on achievements and also the disappointment that the Youth Group had disbanded. He would submit a written update to the next meeting of the Parish Council.

(b) A discussion took place about air traffic over Everton, when it was accepted that training flights represented a considerable amount of current traffic. Hopefully the training flights would decrease as Robin Hood Airport became established.

(c) The minutes of a meeting of the Robin Hood Airport Doncaster/Sheffield Consultative Committee, held on 11th May, 2005, were submitted for the information of Members.

(d) The Chairman drew attention to excellent articles in the CPRE journal ‘Fieldwork’ (June, 2005 edition - to be circulated to Members), on making parish plans count and on how to ensure planning rules were followed. 

05/06/52 NALC NORTHERN AREA COMMITTEE

Councillor Jefferies submitted a brief report on the well-attended meeting of the Northern Area Committee held on 23rd May, 2005. Her report covered the following:

Ÿ An ongoing road safety campaign at Elkesley.

Ÿ A presentation by Ms. Sara Goodwin, Head of Law and Scrutiny at Bassetlaw District Council, on the parish council code of conduct.

Ÿ A presentation by Mr. John Brooks, Head of Financial Services at Bassetlaw District Council, on double taxation, and the possibility of assistance to parish councils (including assumption of responsibility for payroll). 

05/06/53 NORTH EAST BASSETLAW FORUM

The minutes of a meeting of the above, held on 29th March, 2005, were submitted. Copies had been circulated by E-mail to those Members with access to the Internet, and it was agreed that future distribution of Forum minutes be circulated in that manner, with hard copies being posted to those Members without Internet access.

05/06/54 BASSETLAW PARISH COUNCILS LIAISON GROUP

The minutes of a meeting of the above, held on 6th April, 2005, were submitted. The Clerk would endeavour to obtain an electronic copy from Bassetlaw District Council for circulation to those Members with access to the Internet, with future distribution being as at Minute No. 05/06/53 above. 

05/06/55 QUALITY PARISH COUNCIL ACCREDITATION

Councillors Dunn, Jefferies and Maclagan, together with the Clerk, attended a Nottinghamshire ALC training course on 24th May, 2005 on ‘Councillors Behaving Badly’. The course had been informative although it was considered that the presentation could have been improved by better use of the technology available. 

The only recommended practice not followed by the Parish Council was to make a number of agendas available to the public at Parish Council meetings.

Resolved: That five extra copies of the agenda be printed for the above purpose.

05/06/56 ANNUAL REPORT 2004/05

Resolved: That the draft Annual Report, prepared by the Quality Working Party, be approved.

05/06/57 PARISH PATHS PARTNERSHIP

(a) Pursuant to Minute No. 05/06/25 of May, 2005, an E-mail was submitted from Nottinghamshire County Council, thanking the Parish Council for submitting letters and E-mails in support of the creation order at Old Mattersey Road. Further information was also given regarding the actual process of creating the proposed footpath.

(b) Details were given of a number of items of P3 furniture required.

Resolved: That the necessary items be purchased from the P3 account.

(c) Pursuant to Minute No. 04/05/310(c) of March, 2005, a letter was submitted from Mr. T. Scourfield, of Thornely Taylor Estates Company, regarding the possibility of creating a formal footpath along Nutcroft Way into Barrow Hills, through the area of woodland known as ‘The Shroggs’. Mr. Scourfield said that he was unaware of a footpath route through the woodland or an access point linking to Nutcroft Way. However, he intended to discuss the matter with Mr. Thornely Taylor and report back to the Parish Council.

05/06/58 A631 MATTERS

(a) Pursuant to Minute No. 05/06/27(a) of May, 2005, the Clerk reported that he had been promised by Nottinghamshire County Council that the beacon on the pedestrian refuge would be installed by Friday 10th June, 2005.

(b) Resolved: That the Clerk enquire as to whether Nottinghamshire County Council could provide interactive signs on the A631 without the need to comply with Government criteria, as other local authorities appeared to do, e.g. at nearby places such as Bawtry and Woodsetts in South Yorkshire. 

05/06/59 TUNNELTECH NORTH

Councillor Marsh informed Members that there was nothing to report at the moment.

05/06/60 BUILDING BETTER COMMUNITIES

Letter was submitted from Nottinghamshire County Council, inviting the Parish Council to be represented at an annual celebration event at Boughton Pumping Station on 22nd June, 2005.

Resolved: That Councillor Maclagan be authorised to attend.

05/06/61 DONATIONS

Letters of thanks were submitted from Blyth Neighbourhood First Responder Unit, Five Villages First Responders and the WRVS in respect of recent donations by the Parish Council.

05/06/62 CPRE BEST KEPT VILLAGE COMPETITION 2005

The Clerk informed Members that, following discussions with the Competition organisers, Harwell had been entered in the under 300 population category and Everton (including that part of Drakeholes within the Parish of Everton) in the 700 to 2,000 population category.

Members were also informed of community participation and it was agreed that certain works be carried out in order to improve the Parish’s chances of doing well in the Competition. 

05/06/63 CRIME STATISTICS

The crime statistics for May were noted.

05/06/64 COUNTY COUNCIL CIVIC SERVICE

A letter from Nottinghamshire County Council, inviting the Parish Council to be represented at the above, was noted.

05/06/65 THE BASSETLAW PLANNING PROCESS

Pursuant to the discussion earlier in the meeting, Members considered the Chairman’s report on the hearing by Bassetlaw Planning Committee into planning application 19/04/29, and also considered the Bassetlaw Planning process generally.

Resolved:

(a) That the Head of Planning Services be informed of the serious concerns of the Parish Council, as now expressed, over planning application decision-making at Bassetlaw District Council.


(b) That the Head of Planning Services be requested to comment on the various points made by the Chairman in his address to the Planning Committee in respect of planning application 19/04/29, and be informed of the great offence caused by District Councillor Oxby denying that Harwell was a rural community.

(c) That the Clerk write to District Councillor Martin:

(i) informing him that the Parish Council could not understand why he could not stay in a Parish Council meeting when a particular planning application was discussed if he did not intend to participate in the decision-making process at the Planning Committee; 

(ii) requesting his observations on (i) above, and

(iii) asking him whether he was aware that planning application 19/05/5 was not going to be determined by the Planning Committee.

(d) That the Clerk write to the Head of Law and Scrutiny at Bassetlaw, requesting clarification on why the Bassetlaw code of conduct required a member to leave a meeting of the Planning Committee simply because he/she knew the objectors.
