EVERTON PARISH COUNCIL
Minutes of a meeting of the Council held in the Village Hall on Monday 7th February, 2005

04/05/274 APOLOGIES
Apologies for absence were submitted from Councillors Bardsley (unwell) and Troop (unwell) and District Councillor Martin.
04/05/275 DECLARATIONS OF INTEREST
Councillors de Bel and Jefferies each declared a personal interest at agenda item 12 (NEBF Reports), being Parish Council representatives on the North East Bassetlaw Forum.
04/05/276 MINUTES OF THE LAST ORDINARY MEETING OF THE COUNCIL, HELD ON 10TH JANUARY, 2005
The Minutes of the last ordinary meeting of the Council, held on 10th January, 2005, were approved as a correct record.
04/05/277 MATTERS ARISING
(a) Pursuant to Minute No. 04/05/250(a), the Clerk reported that he had been contacted earlier in the day by a resident of Carr View, who complained that, whilst the new street light was welcome, it shone brightly into his bedroom.
The Clerk agreed to draw the matter to the attention of A1 Housing Bassetlaw Ltd.
(b) Pursuant to Minute No. 04/05/258(c), the Clerk reported receipt of a letter from Mr. A. Knight, Clayton House, High Street, Everton, objecting to the introduction of new parking restrictions on High Street. Mr. Clayton’s letter had arrived too late for inclusion on the agenda, and would be considered at the next meeting.
(c) Pursuant to Minute No. 04/05/262, the Clerk reported receipt of a letter from Bassetlaw District Council, explaining that the new Nottinghamshire Association of Local Councils parish council liaison body had been formed, and had been named Northern Area Committee. Its first meeting was to be at Retford on 21st February, 2005.
Resolved:- That Councillor Jefferies serve as the Parish Council's representative on the Northern Area Committee.
04/05/278 PUBLIC DISCUSSION
Mr. J. K. Scott, of Harwell, attended the meeting to express his grave concerns over the damage being caused to Harwell Woods by motorcycle scramblers in particular. He produced photographs relating to the problem.
Mr. Scott was informed that the Parish Council was very much aware of the problem, and was doing its best to tackle it, although most of the land affected was in the ownership of Thornely Taylor Estates Company who were aware of the situation.
During the ensuing discussion, an E-mail from P.c. Gregson was considered, in which he explained the action which he had been taking over the matter. He was to meet a representative of the Estates Company shortly. As regards the BMX ramps, he had spoken to some of the boys, who were from places such as Bawtry, Harworth, Maltby and Tickhill, although they told him that local boys were usually there as well. He had not asked the boys to move on as he wished to ascertain the views of the Parish Council before acting.
A letter was also submitted by a couple from a village some distance away, who regularly walked in the woods. They were appalled at the damage being done by motorcycle scrambling, and explained that the perpetrators were adults.
Resolved:-
(a) That the Clerk have urgent discussions with Mr. Scourfield, the Land Agent at the Estates Company, and P.c. Gregson, with a view to an early meeting or site meeting.
(b) That the writers of the abovementioned letter be thanked for their expression of concern and, subject to their agreement, their letter be printed in HEDS Together without personal details.
(c) That the Clerk seek advice from other appropriate parties, and keep Mr. John Mann, MP informed of the situation.
(d) That the Clerk endeavour to draw the attention of the public to the problem by all available means.
04/05/279 ACCOUNTS
Resolved:- That the February Accounts be approved for payment.
04/05/280 BANK RECONCILIATION
Members received the bank reconciliation statement to 31st December, 2004.
04/05/281 BUDGET MONITORING
There were no changes which needed reporting.
04/05/282 RISK
There were no changes to the Parish Council's risk profile since the last meeting. Members were satisfied that internal controls, financial systems and Financial Regulations were all satisfactory.
04/05/283 MEMBERS’ SURGERIES
Councillor Jefferies held a surgery on 22nd January, 2005. No members of the public attended.
04/05/284 NORTH EAST BASSETLAW FORUM
Councillor Jefferies submitted a report on the meeting of the Forum which she had attended together with Councillor Bardsley on 19th January, 2005. Minutes would be published in due course, but Councillor Jefferies’ report briefly covered the following:
Ÿ A presentation was given on affordable housing, in which the possibility of utilising disused garage sites for such development was discussed.
Ÿ The point made by Gringley on the Hill Parish Council about the lack of logic in members of Bassetlaw Planning Committee absenting themselves from parish council meetings during consideration of planning applications received support, and had been referred to Bassetlaw District Council. The Clerk informed Members that District Councillor Martin supported the initiative.
Ÿ Mr. Jonathan Dawson, Rural Officer at Nottinghamshire Rural Community Council, spoke of his work in co-ordinating Bassetlaw parish councils’ parish plan exercises.
Ÿ A request by Mattersey Parish Council to join the Forum had been unsuccessful
Councillor Jefferies was thanked for her report.
04/05/285 QUALITY PARISH COUNCIL ACCREDITATION
The January newsletter had now been distributed.
04/05/286 PARISH PATHS PARTNERSHIP
(a) The Clerk reported that delivery of the new P3 leaflets was expected later in the week.
(b) Letter was submitted from Nottinghamshire County Council, explaining that written evidence in support of the Parish Council's request for a creation order would be necessary. Mattersey Parish Council had also been written to on the same lines.
Resolved:-
(i) That a letter be sent to Nottinghamshire County Council, reiterating the historical basis of the case whereby, on formal closure of the old road, Nottinghamshire County Council had failed to establish a public footpath as had been intended.
(ii) That the Clerk write articles for HEDS Together and Idle Talk (Mattersey), requesting residents to submit to him written evidence of long usage and need.
(c) Pursuant to Minute No. 04/05/257(d) of January, 2005, the Clerk reported that the required location of an item of deer fencing had been established.
(d) Councillor Dunn reported that he was shortly to install the new dog waste bin on Pinfold Lane, Harwell.
(e) The Clerk confirmed that he had written an article for HEDS Together, drawing attention to the new dog waste bin, and also dealing with the obligations of dog owners using public rights of way.
04/05/287 A631
(a) Pursuant to Minute No. 04/05/258(b) of January, 2005, the Clerk reported that, owing to an oversight, Nottinghamshire County Council had failed to order the necessary governor box for the new beacon. It was now anticipated that the beacon would be installed during the next two weeks.
(b) The Clerk agreed to make further enquiries with Nottinghamshire County Council as to the position regarding the provision of permanent interactive signs.
04/05/288 TUNNEL TECH NORTH LTD.
Councillor Marsh reported that there had been further smell problems, with weekends particularly bad. She also expressed concern that an electrical humming noise seemed to be coming from Tunnel Tech at night.
04/05/289 FIRST RESPONDERS
Correspondence was submitted from Five Village First Responders and Blyth Neighbourhood First Responder Unit. The former letter thanked the Parish Council for its recent donation and further explained the work of Five Villages First Responders. The correspondence from Blyth Neighbourhood First Responder Unit explained that the Unit also covered the Everton area, and it requested financial assistance.
Resolved:- That, before consideration was given to the request for financial assistance by Blyth Neighbourhood First Responder Unit, the observations of Bassetlaw Primary Care Trust be sought on service provision, liaison between First Responder Units, etc.
04/05/290 FREEDOM OF INFORMATION ACT
The following documentation was submitted for the information of Members:
National Association of Local Councils Legal Update No. L03/04, giving details of the general right of access applicable from 1st January, 2005.
National Association of Local Councils Legal Update No. L04/04, giving details of requirements under the Environmental Regulations 1992.
Letter from the Office of the Deputy Prime Minister giving details of the authorisation of Qualified Persons under Section 36 of the Freedom of Information Act 2000. The Secretary of State had decided that, for parish and town councils, the clerk to the council would be primarily authorised and the chairman would be secondarily authorised. For parish meetings, the chairman of the parish meeting would be primarily authorised and the proper officer of the district council would be secondarily authorised.
Resolved:- That the Clerk amend the Parish Council's Publication Scheme, to include details of the format in which published information was available and its source, and to provide an option to charge fees for provision of documents, for submission to the next meeting of the Parish Council.
04/05/291 BASSETLAW SPRING CLEAN
Letter was submitted from Bassetlaw District Council, inviting the Parish Council to participate in the above.
Resolved:- That Bassetlaw District Council be informed that Members of the Parish Council would participate in a Spring clean at Barrow Hills Woods on Sunday 24th April from 11.00 a.m. until noon.
04/05/292 LOCAL TRANSPORT PLAN NORTH NOTTINGHAMSHIRE
A stakeholder consultation document had been received from Nottinghamshire County Council, with a very tight deadline for responses.
Resolved:- That the Chairman be authorised to respond to the document in consultation with other Members.
04/05/293 BASSETLAW COMMUNITY SAFETY PARTNERSHIP - CRIME, DISORDER AND DRUGS AUDIT 2005
A consultation document had been received from Bassetlaw District Council, with a very tight deadline for responses.
Resolved:- That Councillor Macglagan be authorised to respond to the document.
04/05/294 CRIME
(a) The crime statistics for January were submitted.
(b) Pursuant to Minute No. 04/05/265(b) of January, 2005, the E-mail from P.c. Gregson containing the crime statistics explained the position regarding crime detection within rural communities.
(c) Also pursuant to Minute No. 04/05/265(b) of January, 2005, the Clerk reported on his discussions with Inspector France about police investigations of non-domestic burglaries.
04/05/295 ELECTRICITY POWER DISRUPTIONS
Letter was submitted from Yorkshire Electricity Distribution plc, explaining its policy on getting information out to communities when power cuts occurred. The Parish Council was invited to nominate a representative to receive such information, with a view to it being distributed around the Parish.
Councillor Marsh kindly undertook to take on this responsibility.

Members endorsed the action of the Chairman who, in consultation with the Clerk, had removed two items from the Harwell notice board.

Resolved:-
(a) That, subject to the specific observation that the new dovecote should precisely replicate the former dovecote, Bassetlaw District Council be informed that the Parish Council would be happy to agree to whatever observations were made by English Heritage.
(b) That English Heritage be informed accordingly.

Resolved:-
(a) That Bassetlaw District Council be informed that the Parish Council strongly objected to this application on the following grounds:
(i) The site was in open countryside, well out of the village envelope.
(ii) There was a longstanding problem at Park Farm insofar as a barn was erected on bridleway 3 some years ago. Nottinghamshire County Council was still working on the matter. It would appear that the proposed development was also on the right of way.
(b) That Nottinghamshire County Council be informed of the above.
