EVERTON PARISH COUNCIL

Minutes of a meeting of the Council held in the 
Village Hall on Monday 7th November, 2005

05/06/183 APOLOGIES

An apology for absence was submitted by Councillor Woods (unwell).

05/06/184 DECLARATIONS OF INTEREST

There were no declarations of interest at the start of the meeting. Councillor Bacon declared a prejudicial interest later in the meeting at planning application 19/05/34 (24 Long Meadows, Everton) and left the meeting during consideration of that item. On returning to the meeting he declared a personal interest at planning application 19/05/35 (21 Long Meadows, Everton).

05/06/185 MINUTES OF THE LAST ORDINARY MEETING OF THE COUNCIL

The Minutes of the last ordinary meeting of the Council, held on 3rd October, 2005, were approved as a correct record.

05/06/186 MATTERS ARISING

There were no matters arising.

05/06/187 PUBLIC DISCUSSION

No members of the public were present

05/06/188 ACCOUNTS

Resolved: That the November Accounts be approved for payment.

05/06/189 BANK RECONCILIATION

Members received the bank reconciliation statement to 30th September, 2005.

05/06/190 BUDGET MONITORING

The Clerk submitted the September budget monitoring statement, which showed an estimated year-end balance of £4,691.

05/06/191 RISK REVIEW AND ASSET INSPECTION

A discussion took place on the recent theft of a gate from Polly Bell Bank, when Members agreed to take no action regarding its replacement at the present time.

05/06/192 PARISH PLAN

There were no developments to report. 

05/06/193 QUALITY COUNCILS

The Clerk reported that the Accreditation Panel was to hear the Parish Council's application for accreditation on 12th May, 2006. He also drew attention to the fact that the Accreditation Panel would like to see press cuttings of Parish Council matters, and Members agreed to assist in obtaining some.

Members commented generally on the light press coverage of Everton matters, with the exception of the Retford and Bawtry Guardian, and the Clerk was asked to contact the Retford Times to ask if Everton had a village correspondent.

05/06/194 PARISH PATHS PARTNERSHIP

(a) A copy letter from Mattersey Parish Council to Nottinghamshire County Council was submitted regarding a large crack in Old Mattersey Road, some 100 metres north of the Idle bridge.

(b) Letter was submitted from Thornely Taylor Estates Company, regarding the possibility of creating a public footpath from Nutcroft Way to Barrow Hills through The Shroggs. The letter made it clear that a permissive right of way over Estates Company land might be a possibility, but other property rights were involved too.

Resolved:

(i) That the Clerk make enquiries about a permissive right of way being granted on land at the end of Nutcroft Way, not in the ownership of the Estates Company.

(ii) That the Clerk make further enquiries about the highway status of Nutcroft Way with Nottinghamshire County Council. 

05/06/195 HIGHWAY MATTERS

(a) A discussion took place about certain parking problems in the village and attempts being made to resolve them.

(b) Members agreed to keep an eye on the current development at Harwell Sluice Lane/Pinfold Lane, where the verge at Pinfold Lane seemed to be disappearing as a result of the development. 
05/06/196 CASUAL VACANCY

Pursuant to Minute No. 05/06/165 of October, 2005, the Clerk reported that no request had been made for the casual vacancy to be filled by election.

Resolved: That an offer to serve as a co-opted member by Mrs. Krystyna W. Martin be accepted. 

05/06/197 TUNNELTECH NORTH

There was little to report other than the fact that Misson Parish Council was seeking a meeting of the Liaison Committee.

05/06/198 NETWORKING

A letter from Nottingham Community Housing Association was noted.

05/06/199 NEIGHBOURHOOD GOVERNANCE REVIEW AND BASSETLAW AREA ARRANGEMENTS

The Clerk briefly referred to the response of NALC to the Ideas Paper on the Neighbourhood Governance Review.

He then went on to say that, together with the Chairman and Vice-Chairman of North East Bassetlaw Forum, he had attended a meeting of the Bassetlaw District Council Scrutiny Panel on 10th October, 2005. The Panel was looking into the possibility of extending the concept of area forums throughout Bassetlaw. Currently, North East Bassetlaw Forum was the only such body effectively in operation in Bassetlaw. Views were given to the Panel, particularly with regard to the North East Bassetlaw Forum.





05/06/200 PARISH COUNCILS LIASION GROUP MEETING

Letter was submitted from Bassetlaw District Council giving advance notice that the next meeting of the above would be held on 23rd November, 2005 at Worksop Town Hall.

Resolved: That a request be made for ‘local area agreements’ to be included on the agenda.

05/06/201 CHRISTMAS LIGHTS AND DECORATIONS 

A letter from Central Networks, offering grants towards the purchase of Christmas illuminations, was noted. 

05/06/202 MOTORCYCLES IN HARWELL WOODS

Letter was submitted from Mr. John Mann, MP, offering a meeting regarding the above.

After discussing the current situation, Members agreed to thank Mr. Mann for his offer, but to inform him that, although there was currently some nuisance, especially late at night, it was not as bad as that experienced earlier in the year, and no meeting was necessary at the present time. 

05/06/203 CRIME STATISTICS

The crime statistics for October were noted.

05/06/204 VEGETATION AND TREE CLEARANCE PROGRAMME

Letter was submitted from CE Electric UK giving details of its forthcoming programme of vegetation and tree clearance. This was a six-year programme to safeguard the Low Voltage (LV) network of overhead cables and reinforce safety standards.

Resolved: That the Tree Officer at Bassetlaw District Council be requested to ensure that proposed work complied with all planning, etc. requirements

05/06/205 THE FUTURE OF HEALTH SERVICES IN BASSETLAW

Letter was submitted from Mr. John Mann, MP, drawing attention to the fact that, under current proposals, Bassetlaw Primary Care Trust would be merged into a new Trust covering the whole of Nottinghamshire. He pointed out that Bassetlaw had very distinct health needs compared to the rest of Nottinghamshire, and believed that it would be detrimental to health services in the Bassetlaw area if the merger took place. He intended to petition Parliament on the matter and sought local support.

Resolved: That the Clerk write to Mr. Mann, expressing the Parish Council's support for him in this matter.

05/06/206 BARN ADJACENT TO MILL FARM, MATTERSEY ROAD, EVERTON

Letter was submitted from Bassetlaw District Council stating that the owner of the above property wished to name it Marples Barn, Mill Lane, Everton.

Resolved: That no adverse comment be made.

05/05/207 REPLACEMENT NOTTINGHAMSHIRE MINERALS LOCAL PLAN

Letter was submitted from Nottinghamshire County Council confirming its intention to adopt the Plan.

05/06/208 THE BASSETLAW PLANNING PROCESS

District Councillor Martin left the meeting at this point and did not return.

Pursuant to Minute No. 05/06/178 of October, 2005, a letter was submitted from the Chief Executive of Bassetlaw District Council, stating that he was unable to uphold the Parish Council's complaint. He insisted that the Head of Planning Services had answered technical questions put to him by the Parish Council. 

Resolved:

(a) That the Clerk write to the Chief Executive, informing him that the Parish Council remained unhappy about the whole matter. Furthermore, in addition to the Parish Council losing confidence in the Bassetlaw planning process, there was also a loss of confidence amongst the public of Everton.

If the Chief Executive continued to insist that the questions referred to had been answered, a meeting be requested between representatives of the Parish Council, the Leader of Bassetlaw District Council and the Chairman of the Planning Committee.

(b) That Mr. John Mann MP be informed of the latest position.

Demolish two 3.5m lengths of outbuilding leaving roofs in position at Pear Tree Farm, Gainsborough Road, Everton

Resolved: That Bassetlaw District Council be informed that the Parish Council took the view that this application was inconsistent with application 19/05/29 and observed that leaving the roofs in position would block access for construction traffic.

Furthermore, an enquiry be made as to whether the opinions of the Bassetlaw Conservation Officer, CPRE and English Heritage were being sought on this application.

The Parish Council wished firstly to raise two specific objections to this application (Nos. i and ii) and then, as the application was associated with 19/05/29, to repeat the strong objections raised to that application (Nos. iii –xiii):

i. The Nottinghamshire Structure Plan Review included policy 3/17 that the historic and architectural character of the County would be protected. The proposed development would not protect and maintain the listed building involved and, as such, the proposal would be contrary to this policy of the development plan and would conflict with its objectives. Similar advice was contained in the Bassetlaw Local Plan and in the relevant Planning Policy Guidance Note.

ii. The Bassetlaw Local Plan contained policy 6/10 indicating that development affecting listed buildings would be acceptable only where the character, appearance and setting of the building was not adversely affected. The development would be to the detriment of the listed building and would, therefore, be contrary to this policy and would conflict with the objective of the Plan.

iii. Neither the materials nor the construction details were detailed on the plans.

iv. The east elevation on the plans failed to show the slope of the land, and, therefore, the blank wall facing the property to the east did not show true the height (higher than on the plans)

v. The development would have an adverse effect on Haven Cottage to the east, as it was very dominant and would tower over a very narrow gap between the house and outbuildings and the eastern wall of the development, which was two-storey for a large part of the distance.

vi. There were a number of inconsistencies between the plans and the architect’s letter, which, having reference numbers thereon, appeared be part of the submission. At one point the letter stated: “ ...we enclose a drawing at a scale of 1:500 which has been agreed with Mr G Chambers of Notts County Council Highways Department”. This drawing showed the two existing buildings adjoining the road as being truncated with the notation: “Building and boundary wall on roadside of Pear Tree Farm to be lowered to 900mm above carriageway”. But the letter from the architect stated: “The two existing buildings adjoining the road to the west of the site will have their roof and gables retained and will simply be opened up to allow vehicles to pass under. There will, therefore, be minimal impact on the existing buildings on site”. This seemed highly unlikely as both buildings were old and in fragile condition, also allowing only cars to pass under - not vans or delivery vehicles.

vii. There was no mention or drawing of the existing access (which was considered too dangerous for a previous planning application) to be stopped up/sealed off. There was a possibility of the circuitous route on the plan being ignored after a short time and access/egress made through the existing gate.

viii. Planned access to the site was on a dangerous section of the A631 and the likelihood was that there would be more than one vehicle using this property (see 4 garage spaces). Together with the planned development of the other barns, this would create a large traffic use through an inadequate entry point.

ix. The plans showed two master bedrooms, one on the ground floor and one on first floor, and three other bedrooms, but only one bathroom. None of the bedrooms were shown en-suite. Were the plans inadequate or incomplete?

x. Members understood that the outbuildings were used by bats, and, therefore, requested a visit by a local bat group.


xi. Pear Tree Farm and its associated farm buildings formed an important and prominent group of listed buildings located on a major road. The necessary demolition work would not maintain the existing special character of these buildings and would subsequently detract from the listed buildings and their settings. Such demolition would be contrary to the policies of the development plan and the Local Plan.

xii. The Bassetlaw Local Plan contained policy 5/3 which stated that planning permission would be granted for residential development in settlement envelopes provided that it was in character with the area, provided adequate residential amenity and did not create traffic problems. The development, if permitted, would be contrary to this policy and would conflict with the objectives of the plan.

xiii. The form and detailing of the proposed dwelling paid little regard to the character and appearance of the traditional buildings in the immediate area and the adjacent listed buildings. As such, the proposed dwelling would be out of character with the area and detract from the setting of the listed buildings. 

In conclusion, the Parish Council was strongly opposed to this application for the reasons stated above. In particular it wished to stress the adverse impact on the amenity of the adjacent property and the alteration of existing old buildings. Although the applicant stated that the development eliminated a dangerous access, this access in practice had very rarely been used, and the main access, which was almost as bad, would have to carry additional traffic. The access had already changed from serving one house to potentially two, and the proposed development would add a third. 

A site visit by the Planning Committee was emphatically requested, to enable its Members to get a true idea of the extent of this proposal and the adverse effect on the neighbouring property. Anyone standing on the pavement of the A631, as Members of the Parish Council did at a site meeting, would appreciate the problems with the access and the large traffic flow.
